Patent Reexamination

To request the cancellation of a patent with the United States Patent and Trademark Office (USPTO), you would typically file a petition or request for post-grant review. This involves submitting a formal request to the USPTO to challenge the validity of the patent and seek its cancellation. The process requires presenting evidence and arguments, such as prior art or other grounds that demonstrate the patent should not have been granted.

WHAT IS PATENT REEXAMINATION?

A competitor holds a patent that may be preventing you from developing that invention. Request the US Patent Office to reassess whether the patent was warranted from the start. It might be possible to persuade the Patent Office that the patent was improperly granted.

Several Steps Required
